notes on new mexico & scenes from an airport

"there's a new mexico?" as many of you know, we went 'off the grid' last week. although we did discover some wi-fi by the second day, i still stuck to my 'internet fast' for the most part. but i took notes on some of the interesting things that happened while visiting family in taos, here are some highlights:

- we saw shirley maclaine at the santa fe airport, she was wearing a big jacket that said 'ghetto blaster' on the back

- there's a pretty cool radio station called ktao 101.9fm (it's solar powered!); and i was listening for the emergency alert system test to happen, but they didn't participate. (here's what the test looked like elsewhere) and apparently, they weren't alone: 'emergency drill fails in new mexico'

- meanwhile, they're working on something called the 'taos regional command communications center'. brought to you by homeland security & the local 'power' company kit carson, it basically looks to be a consolidation of emergency, power & communication services. and, of course: "this system will also be responsible for monitoring cyber security tied to smart grid and green grid systems."

- our plane out of santa fe was delayed, which made us miss our connection at lax... yesterday, i saw this article about the airline we used: 'dept. of transportation issues first fine against airline for tarmac delay'

- i hope keane made a lot of money licensing "everybody's changing" to alaska airlines, but damn i used to really like that song...

- the council on foreign relations magazine, foreign affairs, was prominently displayed on sale at the newport news store in the los angeles international airport.

- i had my first chance to opt-out of the radioactive naked body scanners at lax; instead, i got felt up by a very nice gentlemen who didn't even tell me his name. it was around this point that i remembered it was veteran's day & that's why it was so crowded... we were reminded once again that it was a holiday by the fine folks at heinz ketchup.

homeland security testing 'pre-crime' detection technology

from allgov: The Department of Homeland Security (DHS) has been secretly working on technology that can tip off law enforcement about those planning to commit a crime. Part profiling, part advanced mathematics, the Future Attribute Screening Technology (FAST) is described as a “pre-crime” system by DHS. The program uses ethnicity, gender, breathing, eye tracking and heart rate to formulate a system for spotting criminals before they strike. According to the official description, the prototype contains “a suite of real-time, non-invasive sensor technologies to detect cues indicative of mal-intent (the intent or desire to cause harm).” A classified DHS document reportedly indicated that the controversial idea is already being tested on some members of the public voluntarily. If the technology proves reliable, the government might try using it at airport checkpoints, border crossings, sea ports or major sporting events.

tony bennett on 9/11: 'they flew the plane in, but we caused it'

from abcnews: American icon Tony Bennett took to the airwaves at Sirius Radio to promote his new album, “Duets II,” but it’s what he said about war, peace, terrorism, and who was to blame for the Sept. 11 terror attacks that could get people talking. Sitting down with Howard Stern on Monday, the 85-year-old singer dodged questions about his sex life and prior drug use. He did so with a laugh, but matters about the U.S. military and 9/11 were fair game, and on these topics the Grammy winner held little back...

Bennett, 65 years after leaving his military life behind, has sold over 50 million albums and developed definite opinions about other wars involving the United States. “To start a war in Iraq was a tremendous, tremendous mistake internationally,” he said. Stern then asked Bennett about how America should deal with terrorists, specifically those responsible for the 2001 attack on the World Trade Center. “But who are the terrorists? Are we the terrorists or are they the terrorists? Two wrongs don’t make a right,” Bennett said.

In a soft-spoken voice, the singer disagreed with Stern’s premise that 9/11 terrorists’ actions led to U.S. military involvement in Iraq and Afghanistan. “They flew the plane in, but we caused it,” Bennett responded. “Because we were bombing them and they told us to stop.” Following seconds of silence, Stern said that his guest was “making some good points.”

from abcnews: The three bystanders who chased and helped capture a member of the fugitive Dougherty Gang after Wednesday's high-speed police chase ended in a crash had no idea who they were helping to apprehend, they said on "Good Morning America" today. "We heard the shots, we see all of the officers coming down the on-ramp with the guns drawn and the M-16s out, surrounding this car that's up on the guardrail, and we're like, 'Man, what's happening?' You don't hear that every day," said Dave Dallaguardia, one of the three highway workers who helped catch the runaway Dougherty. It's unclear which brother they captured. Lee Dougherty, who is a 29-year-old stripper, and heavily armed brother Ryan, 21, and half-brother Dylan Dougherty Stanley, 26, had become the focus of a manhunt that stretched from Florida to Colorado in the past week.

9/11 survivors lawsuit against united airlines given go-ahead

9/11 mother to make legal history suing over son's 21 minutes of terror before his doomed flight hit world trade center
from allgov: In the 10 years since the September 11, 2001, terrorist attacks, thousands of survivors have settled their lawsuits against the airlines and other parties, and collected awards totaling billions of dollars. But one family has held out so it can have its day in court, and that time is finally approaching.

The plaintiff is the mother of Mark Bavis, one of the passengers aboard United Airlines Flight 175, the second plane to strike the World Trade Center. She is suing United and Huntleigh USA, the security company that screened passengers at Logan International in Boston, where the flight originated.

Bavis’ family contends that he and the other passengers would not have died had United and Huntleigh done their jobs and thus thwarted the hijackers who flew the airliner into the South Tower.

They blame United for ignoring government warnings about terrorist threats and Huntleigh for inadequate screening of passengers.

Her attorneys intend to portray the last minutes of the flight as sheer terror, based on phone calls made by other passengers. In a pretrial motion United’s legal team tried to keep Bavis from pursuing pain-and-suffering damages for the last moments of her son’s life. But a federal judge, Alvin Hellerstein, ruled this week that he is inclined to allow the trial’s jury to formulate an amount for such damages.

The wrongful-death case is expected to go to trial in November.

court ok's naked body scanners, rejects constitutional challenge

from threat level: A federal appeals court on Friday unanimously declined to block the government from using intrusive body scanners across airports nationwide, saying it is “not persuaded by any of the statutory or constitutional arguments” against them. The U.S. Court of Appeals for the District of Columbia Circuit was deciding a constitutional and procedural challenge to the Advanced Imaging Technology “nude” body scanners, which began rolling out in 2007 and are deployed to at least 78 airports nationwide. The Electronic Privacy Information Center asked the court to block usage of the devices — of which 500 more are to be rolled out this year — on grounds that they are an unconstitutional privacy invasion, ineffective and unhealthy to airline passengers.

“The petitioners argue that using AIT for primary screening violates the Fourth Amendment because it is more invasive than is necessary to detect weapons or explosives,” the appeals court noted. “As other circuits have held, and as the Supreme Court has strongly suggested, screening passengers at an airport is an ‘administrative search’ because the primary goal is not to determine whether any passenger has committed a crime but rather to protect the public from a terrorist attack.”

The court said that, whether an administrative search is unreasonable, is a balancing test on how much it intrudes upon an individual’s privacy, and how much that intrusion is needed for the promotion of “legitimate” government interests. “That balance clearly favors the government here,” the court ruled 3-0. The court added that an “AIT scanner, unlike a magnetometer, is capable of detecting, and therefore of deterring, attempts to carry aboard explosives in liquid powder form.” The three-judge appellate panel did not address limited research suggesting that the machines might not detect explosives or even guns taped to a person’s body.

unchecked power for worldwide war hidden in 'defense authorization'

from aclu.org: Tucked inside the National Defense Authorization Act, being marked up by the House Armed Services Committee this week, is a hugely important provision that hasn't been getting a lot of attention — a brand new authorization for a worldwide war.

This stealth provision was added to the bill by the committee's chairman, Rep. Buck McKeon (R-Calif.), but has a bit of a history. It was first proposed by former Attorney General Michael Mukasey in 2008 after the Bush administration lost the Boumediene v. Bush case, in which the Supreme Court decided that federal courts would subject the administration's asserted law of war basis to hold Guantanamo detainees to searching review. An idea that may have originally been intended to bolster the Bush administration's basis for holding Guantanamo detainees is now being promoted as an authorization of a worldwide war — and could become the single biggest ceding of unchecked war authority to the executive branch in modern American history.

from the new american: Americans concerned about exposure to potentially dangerous levels of radiation from the Transportation Security Administration’s full-body scanners just got another reason to worry: USA Today reports that on March 11 the TSA announced “that it would retest every full-body X-ray scanner that emits ionizing radiation — 247 machines at 38 airports — after maintenance records on some of the devices showed radiation levels 10 times higher than expected.” The TSA, of course, insists that all the machines are safe and that the records indicating the high radiation levels are the result of recordkeeping errors by technicians. TSA spokesman Nicholas Kimball told USA Today that, for example, “the testing procedure calls for the technician to take 10 separate scans” for radiation levels, “add them up and then divide by 10 to take an average. They didn’t divide by 10.” In addition, says the paper, “even the highest readings listed on some of the records — the numbers that the TSA says were mistakes — appear to be many times less than what the agency says a person absorbs through one day of natural background radiation.”

from activist post: A new level of invasive screening is scheduled for airports this summer: a portable DNA scanner to conduct on-site, real-time genetic testing.

This technology is being implemented under the cover of combating human trafficking, illegal immigration, and finding missing persons, but Richard Seldon of NetBio, creator of the scanners, clearly states that "DNA information has the potential to become part of the fabric of day-to-day life." In an interview with Katie Drummond who broke this story for The Daily, Seldon envisions additional applications in emergency rooms, food safety tests, and law enforcement.

DNA collection is actually nothing new, as the Pentagon has admitted that it currently has a DNA database with 80,000 suspected foreign terrorists on it, and growing daily. However, this collection apparatus has been secretly in place for Americans as well...

It is important to note that the technology of tracking, tracing, and databasing innocent people right down to their blood is a top-down directive from federal agencies, not a legitimate scientific endeavor. Legitimate science researches ways to increase human potential and freedom, not use it as a system for identification and control. With the rise of nanotechnology as a federal initiative, we should strongly resist the collection of our life force to be used in any way that government-controlled science sees fit.

house extends key patriot act provisions

"patriot act" extension lands on "president's" desk
from threat level: The House voted Monday to extend to December three expiring provisions of the Patriot Act spy legislation. The measure’s passage, by a 275-144 vote, was expected. The three provisions are expiring at month’s end. Rather than seriously debate or alter them, the House punted — the third failure by Congress in more than a year to address the law’s controversial issues. The measure now goes before the Senate, which is likely to follow the House’s course on legislation that was hastily adopted following the September 11, 2001, terror attacks. Here are the expiring provisions the House adopted:

• The “roving wiretap” provision allows the FBI to obtain wiretaps from a secret intelligence court, known as the FISA court (for Foreign Intelligence Surveillance Act), without identifying the target or what method of communication is to be tapped.

• The “lone wolf” measure allows FISA court warrants for the electronic monitoring of a person for whatever reason — even without showing that the suspect is an agent of a foreign power or a terrorist. The government has said it has never invoked that provision, but the Obama administration said it wanted to retain the authority to do so.

• The “business records” provision allows FISA court warrants for any type of record, from banking to library to medical, without the government having to declare that the information sought is connected to a terrorism or espionage investigation.

from norad: The Federal Aviation Administration is preparing for a busy Thanksgiving holiday travel week by working with the Department of Defense to clear the way for commercial aircraft to fly in airspace normally reserved for the military.

“We want to do everything we can to make it easier for people to travel so they can spend Thanksgiving with their loved ones,” said U.S. Transportation Secretary Ray LaHood. “We appreciate the military’s help in making this happen.”

Air traffic controllers may begin routing commercial aircraft through the restricted airspace at 6 a.m. EST on Tuesday, Nov. 23, a day earlier than in previous years. The use of restricted airspace will end at 6 a.m. EST on Monday, Nov. 29. The busiest travel days are expected to be Tuesday, Wednesday and Sunday.

Under the agreement, DOD will release airspace off the east coast above 24,000 feet. The added capacity is expected to ease delays during one of the busiest travel periods of the year, saving time and money for passengers and airlines while reducing fuel burn.

The FAA has developed dedicated routes off the east coast to allow airlines to plan their flights through the normally restricted airspace. Normal inland routes will still be available. Weather permitting, the combination of both sets of routes is expected to ease congestion.

“The FAA is using all the tools available to try and give airlines the most efficient routes so air travelers can reach their destinations safely and on time,” said FAA Administrator Randy Babbitt.

“The nation’s air traffic controllers are committed to upholding the safety of the system while working the most efficient airspace system in the world,” said NATCA President Paul Rinaldi. “Over the past year we’ve experienced a movement toward collaboration at all levels of the agency and we look forward to continuing to work together to improve air travel for the flying public.”

The DOD is also allowing commercial flights to use restricted airspace in other parts of the country. These include:

• Airspace over the Gulf of Mexico to ease congestion for commercial aircraft flying between Florida and the Louisiana and Texas areas, as well as points beyond.
• Airspace over Twentynine Palms in California to ease congestion for commercial aircraft flying to and from markets in Southern California.
• Airspace over the White Sands Missile Range in New Mexico to allow for more direct routings for aircraft flying over the Southwest.
