notes on new mexico & scenes from an airport

notes on new mexico & scenes from an airport"there's a new mexico?" as many of you know, we went 'off the grid' last week. although we did discover some wi-fi by the second day, i still stuck to my 'internet fast' for the most part. but i took notes on some of the interesting things that happened while visiting family in taos, here are some highlights:

- we saw shirley maclaine at the santa fe airport, she was wearing a big jacket that said 'ghetto blaster' on the back

- there's a pretty cool radio station called ktao 101.9fm (it's solar powered!); and i was listening for the emergency alert system test to happen, but they didn't participate. (here's what the test looked like elsewhere) and apparently, they weren't alone: 'emergency drill fails in new mexico'

- meanwhile, they're working on something called the 'taos regional command communications center'. brought to you by homeland security & the local 'power' company kit carson, it basically looks to be a consolidation of emergency, power & communication services. and, of course: "this system will also be responsible for monitoring cyber security tied to smart grid and green grid systems."

- our plane out of santa fe was delayed, which made us miss our connection at lax... yesterday, i saw this article about the airline we used: 'dept. of transportation issues first fine against airline for tarmac delay'

- i hope keane made a lot of money licensing "everybody's changing" to alaska airlines, but damn i used to really like that song...

- the council on foreign relations magazine, foreign affairs, was prominently displayed on sale at the newport news store in the los angeles international airport.

- i had my first chance to opt-out of the radioactive naked body scanners at lax; instead, i got felt up by a very nice gentlemen who didn't even tell me his name. it was around this point that i remembered it was veteran's day & that's why it was so crowded... we were reminded once again that it was a holiday by the fine folks at heinz ketchup.

i also drove a car for the first time in a decade, saw petroglyphs & more that i'll mention on the upcoming episode239... thanks for indulging me, james

court ok's naked body scanners, rejects constitutional challengefrom threat level: A federal appeals court on Friday unanimously declined to block the government from using intrusive body scanners across airports nationwide, saying it is “not persuaded by any of the statutory or constitutional arguments” against them. The U.S. Court of Appeals for the District of Columbia Circuit was deciding a constitutional and procedural challenge to the Advanced Imaging Technology “nude” body scanners, which began rolling out in 2007 and are deployed to at least 78 airports nationwide. The Electronic Privacy Information Center asked the court to block usage of the devices — of which 500 more are to be rolled out this year — on grounds that they are an unconstitutional privacy invasion, ineffective and unhealthy to airline passengers.

The petitioners argue that using AIT for primary screening violates the Fourth Amendment because it is more invasive than is necessary to detect weapons or explosives,” the appeals court noted. “As other circuits have held, and as the Supreme Court has strongly suggested, screening passengers at an airport is an ‘administrative search’ because the primary goal is not to determine whether any passenger has committed a crime but rather to protect the public from a terrorist attack.”

The court said that, whether an administrative search is unreasonable, is a balancing test on how much it intrudes upon an individual’s privacy, and how much that intrusion is needed for the promotion of “legitimate” government interests. “That balance clearly favors the government here,” the court ruled 3-0. The court added that an “AIT scanner, unlike a magnetometer, is capable of detecting, and therefore of deterring, attempts to carry aboard explosives in liquid powder form.” The three-judge appellate panel did not address limited research suggesting that the machines might not detect explosives or even guns taped to a person’s body.

tsa records show some scanners emit ten times expected radiationfrom the new american: Americans concerned about exposure to potentially dangerous levels of radiation from the Transportation Security Administration’s full-body scanners just got another reason to worry: USA Today reports that on March 11 the TSA announced “that it would retest every full-body X-ray scanner that emits ionizing radiation — 247 machines at 38 airports — after maintenance records on some of the devices showed radiation levels 10 times higher than expected.” The TSA, of course, insists that all the machines are safe and that the records indicating the high radiation levels are the result of recordkeeping errors by technicians. TSA spokesman Nicholas Kimball told USA Today that, for example, “the testing procedure calls for the technician to take 10 separate scans” for radiation levels, “add them up and then divide by 10 to take an average. They didn’t divide by 10.” In addition, says the paper, “even the highest readings listed on some of the records — the numbers that the TSA says were mistakes — appear to be many times less than what the agency says a person absorbs through one day of natural background radiation.”

military runs nationwide exercise 'solid curtain/citadel shield' feb21-25from cnic.navy.mil: Exercise SOLID CURTAIN-CITADEL SHIELD 2011 will be conducted on naval bases and installations throughout the continental United States, Hawaii and Guam from Feb. 21-25, 2011. This annual exercise is designed to enhance the training and readiness of Navy Security Forces to respond to threats to installations and units. Exercise SOLID CURTAIN-CITADEL SHIELD 2011 is not in response to any specific threat, but is a regularly-scheduled exercise. Measures have been taken to minimize disruptions to normal base and station operations, but there may be times when the exercise causes increased traffic around bases or delays in base access. Area residents may also see increased security activity associated with the exercise. outrage at tsa grows as 'opt out day' planned for nov24from threat level: Air travelers, mark your calendar. An activist opposed to the new invasive body scanners in use at airports around the country just designated Wednesday, Nov. 24 as a National Opt-Out Day. He’s encouraging airline passengers to decline the TSA’s technological strip searches en masse on that day as a protest against the scanners, as well as the new “enhanced pat-downs” inflicted on refuseniks.

The goal of National Opt-Out Day is to send a message to our lawmakers that we demand change,” reads the call to action at OptOutDay.com, set up by Brian Sodegren. “No naked body scanners, no government-approved groping. We have a right to privacy, and buying a plane ticket should not mean that we’re guilty until proven innocent.”

Some travel writers have expressed concern that the protest, called for the busiest air-travel day of the year, could cause backups and delays for all travelers.

The planned protest taps a growing unease over the full-body scans. Privacy groups such as the Electronic Privacy Information Center are seeking a court order to halt the use of invasive scanners, saying the scanners are illegal and violate passenger privacy.

They also say the government has done little to ensure that images taken by the devices are not saved. The TSA has asserted that the machines cannot store pictures, but security personnel at a courthouse in Florida were found to not only have saved images but shared them among colleagues in order to humiliate one of their co-workers.

Scientists have also expressed concern that radiation from the devices could have long-term health effects on travelers.

pilot refuses naked body scanner & 'pat down'from cnn: A pilot who refused to submit to a full-body scan or the alternative pat down going through airport security said the procedures violate his rights. Michael Roberts, a pilot for ExpressJet Airlines, refused a full-body scan last week at a Transportation Security Administration check point at Memphis International Airport in Memphis, Tennessee.

Opting out of scanning is permitted, but those who opt out must receive an enhanced pat down from a TSA employee. "Pat down is misleading," Roberts said. "They concentrate on the area between ... the upper thighs and torso, and they're not just patting people's arms and legs, they're grabbing and groping and prodding pretty aggressively."

Roberts said TSA security measures are ineffective, and cited concerns for his rights and privacy in refusing the procedures. "I was trying to avoid this assault on my person, and I'm not willing to have images of my nude body produced for some stranger in another room to look at either," Roberts told CNN. The TSA said in a statement that "security is not optional" and any person who refuses security screening is not allowed to fly.

gadsden flags start disputes around the countryfrom the upshot: An Arizona man is in trouble with his homeowners' association over flying the Gadsden flag, which features a coiled rattlesnake and the words "Don't Tread on Me." The flag has been adopted by members of the tea party movement for its association with the American Revolution, but Andy McDonel tells the New York Times that he has hung the flag from his roof simply for its historical significance.

Arizona has a state statute that allows Arizonans to fly "the Stars and Stripes, the state flag, flags representing Indian nations as well as the official flags of the Army, Navy, Air Force, Marines and Coast Guard," the Times reports.


McDonel's homeowners' association is strictly interpreting that law to ban the flying of any other flags, including the Gadsden. The American Civil Liberties Union is defending McDonel, saying the homeowners' group is taking too strict a view of the statute and restricting McDonel's right to free speech. McDonel is chronicling his struggle on a blog, where he is asking for donations for a potential legal battle. McDonel isn't the only person to run into a dispute over the historic flag.
