The U.S. Supreme Court has yet to decide whether the First Amendment is implicated in fingerprinting, especially at a time when states, local governments and civic organizations are increasingly making them mandatory for anyone wanting to drive a car or coach a youth basketball team.

video update: ft hood shooters were soldiers; key details emerge from huffpo: Officials say a shooting suspect at Fort Hood has been identified as Maj. Malik Nadal Hasan, who they say was an Army mental health professional. A law enforcement official said Hasan, believed to be in his late 30s, was killed after opening fire at the base. The official spoke on condition of anonymity because he was not authorized to discuss the case publicly. A defense official speaking on condition of anonymity says Hasan was a mental health professional – an Army psychologist or psychiatrist. It was not known whether he was treating people at the base. Officials says it was not clear what Hasan's religion was, but investigators are trying to determine if Hasan was his birth name or if he may have changed his name and converted to the Islamic faith at some point.
navy vessel built with 9/11 steel sails up ny's hudson river from dpa: News reports said the USS New York stopped at a pier in lower Manhattan facing the new World Trade Center under construction to pay tribute for those killed in the September 11, 2001, attacks. Welcoming the vessel at the pier were police, firefighters, military personnel and family members of the victims. The vessel will dock at Pier 88 on the Hudson River alongside the USS Intrepid, now a floating museum visited by tourists, while visiting New York City.
11/5 update ... you can't make this stuff up: israel proposes work camps for illegal migrants from haaretz: The government is considering establishing work camps in the south of the country, where illegal migrant workers will receive shelter, food and medical care, Army Radio reported Wednesday. In exchange, illegal migrants would perform manual labor outside the camps, but would not earn a salary... "I fear how far we have fallen," said MK Dov Khenin (Hadash) in reaction to the work camp proposal, adding that he thinks the plan would encourage many more asylum seekers to try to enter Israel.

A recently declassified oral history by Brigadier General Godfrey McHugh, President Kennedy's military aide on the Dallas trip, sheds new light on the critical hours after the shooting. McHugh makes startling claims about Lyndon Johnson's behavior in the wake of the assassination.
The interview with McHugh, originally conducted for the John F. Kennedy Library in 1978, remained closed for 31 years. It was finally declassified in the spring of 2009. I just happened to be working at the Kennedy Library on the day the interview was opened to the public and have used it for the first time in my new book, The Kennedy Assassination: 24 Hours After...
McHugh, like most members of the Kennedy entourage, did not know that Johnson was onboard. They believed that the new president was on his own plane flying back to Washington. If LBJ was on the plane, McHugh wanted to see for himself. Since he had not seen Johnson in the aisle -- and at 6'4" Johnson would be tough to miss -- McHugh assumed that he must then be in the bedroom. When he checked there Johnson was nowhere to be seen. The only place on the plane he had not inspected was the bathroom in the presidential bedroom.
What McHugh claimed to have witnessed next was shocking. "I walked in the toilet, in the powder room, and there he was hiding, with the curtain closed," McHugh recalled. He claimed that LBJ was crying, "They're going to get us all. It's a plot. It's a plot. It's going to get us all.'" According to the General, Johnson "was hysterical, sitting down on the john there alone in this thing."

operation rotten apple: huge drug bust near yankee stadium from abcnews: As ground crews were cleaning the fields of Yankee Stadium early this morning, 450 law officers were cleaning the streets of three drug gangs just ten blocks away. The three gangs had operated openly in two Bronx housing projects, selling crack cocaine and heroin. Officers seized glassine bags of heroin labeled "American Gangster," "Scorpion," and "Poison." They made 40 arrests and searched 22 locations. The main drug dealing operation shut down was dubbed "the Courtland Avenue Organization." Two other gangs were also shut down, federal and local authorities said.

During a 12-month period ended in March this year, for example, the U.S. intelligence community suggested on a daily basis that 1,600 people qualified for the list because they presented a "reasonable suspicion," according to data provided to the Senate Judiciary Committee by the FBI in September and made publiclast week.
FBI officials cautioned that each nomination "does not necessarily represent a new individual, but may instead involve an alias or name variant for a previously watchlisted person."
The ever-churning list is said to contain more than 400,000 unique names and over 1 million entries. The committee was told that over that same period, officials asked each day that 600 names be removed and 4,800 records be modified. Fewer than 5 percent of the people on the list are U.S. citizens or legal permanent residents. Nine percent of those on the terrorism list, the FBI said, are also on the government's "no fly" list.
