Led By Oregon's Wyden, Opposition Grows Against Obama's Refusal to Reveal Secret Patriot Act Powers

from allgov.com: Congressional Democrats, the media and civil libertarians are continuing their fight with President Barack Obama over his administration’s secret interpretations of the Patriot Act. Senators Ron Wyden of Oregon and Mark Udall of Colorado, who sit on the Senate Intelligence Committee, wrote to Attorney General Eric Holder last week claiming a classified intelligence operation based on the Patriot Act interpretation is not as critical to national security as the administration says.

Wyden and Udall also wrote that Americans would be “stunned” if they knew what the government was really doing based on the legal theory being employed through the Patriot Act. In October, Sen. Richard Durbin (D-Illinois) said that the government’s use of “Section 215 is unfortunately cloaked in secrecy. Some day that cloak will be lifted, and future generations will ask whether our actions today meet the test of a democratic society: transparency, accountability, and fidelity to the rule of law and our Constitution.”

The Department of Justice has insisted that revealing anything about the secret spy program could “cause exceptionally grave damage to the national security of the United States.” Federal lawyers are trying to dismiss two lawsuits, one by The New York Times and the other by the American Civil Liberties Union and the Electronic Frontier Foundation, that seek to force the administration into disclosing how the Patriot Act has been interpreted.

coming soon: 'automotive black boxes' for every vehicle

coming soon: 'automotive black boxes' for every vehiclefrom autopia: Next month, the National Highway Traffic Safety Administration is expected to declare that all vehicles must contain an event data recorder, known more commonly as a “black box.” The device, similar to those found in aircraft, records vehicle inputs and, in the event of a crash, provides a snapshot of the final moments before impact. That snapshot could be viewed by law enforcement, insurance companies and automakers. The device cannot be turned off, and you’ll probably know little more about it than the legal disclosure you’ll find in the owner’s manual. The pending mandate looks to some like a gross overreach of government authority, or perhaps an effort by Uncle Sam, the insurance industry and even the automakers to keep tabs on what drivers are doing. But if you’re driving a car with airbags, chances are there’s already one of these devices under your hood... How much it affects you depends upon where you live and what data points it records. How much it will affect you in the future may depend on a new set of standards that spell out exactly what data is collected and who can access it.

house extends key patriot act provisions

"patriot act" extension lands on "president's" desk
house extends key patriot act provisionsfrom threat level: The House voted Monday to extend to December three expiring provisions of the Patriot Act spy legislation. The measure’s passage, by a 275-144 vote, was expected. The three provisions are expiring at month’s end. Rather than seriously debate or alter them, the House punted — the third failure by Congress in more than a year to address the law’s controversial issues. The measure now goes before the Senate, which is likely to follow the House’s course on legislation that was hastily adopted following the September 11, 2001, terror attacks. Here are the expiring provisions the House adopted:

• The “roving wiretap” provision allows the FBI to obtain wiretaps from a secret intelligence court, known as the FISA court (for Foreign Intelligence Surveillance Act), without identifying the target or what method of communication is to be tapped.

• The “lone wolf” measure allows FISA court warrants for the electronic monitoring of a person for whatever reason — even without showing that the suspect is an agent of a foreign power or a terrorist. The government has said it has never invoked that provision, but the Obama administration said it wanted to retain the authority to do so.

• The “business records” provision allows FISA court warrants for any type of record, from banking to library to medical, without the government having to declare that the information sought is connected to a terrorism or espionage investigation.

'patriot act' extensions down, but not out

'patriot act' extension to be brought up again next week?
'patriot act' extensions down, but not outfrom kenny's sideshow: The good news is that for the first time in years an unconstitutional police state law is 'shot down.' At least for the time being. The bad news is that Patriot Act extension failed because of a procedural move that required a two-thirds majority that fell short with 277 voting yes and 148 voting no. Which means that the majority of Congress are still traitors who don't give a flip about our rights and who remain shills for the lies of the 'war on terror.' Some are predicting the bill will return to the House floor for a regular vote that would only require a simple majority to pass. Obama, doing his best George W. Bush impression, wanted the extension to go through December 2013. A Republican sponsored the extension until December 2011. Most democrats voted no, all repubs but 26 voted yes. That's a crazy mix even for the false left/right paradigm.

wikileaks being used to justify an 'internet patriot act'

wikileaks being used to justify an internet patriot actfrom activist post: Over the weekend, an insightful article by Zen Gardner exposed how WikiLeaks resembles an establishment creation. The article correctly pointed out that the WikiLeaks storyline was conforming nicely to the elite's problem-reaction-solution method, with the solution of more tyranny for our safety. WikiLeaks is being used to bring in the agenda on so many levels, but most importantly by setting the precedent of shutting down websites for politically 'dangerous' content. Gardner writes:

"After all, if information is now the enemy, we must carefully police any and every aspect of this dangerous medium - all for the safety and protection of 'we the people.' Oh, we’ll still have the Internet, just like you can still fly. You’ll just have to be on the 'approved' list, screened, stamped, zapped, mugged and molested if you want to get 'on the net.' No biggie. Thanks Julian -- job well done."

First, let's be clear, the 250,000 pages of cables amounted to some geopolitical Jerry Springer he-said-she-said nonsense to make countries look petty and stupid. They revealed nothing new that wasn't already known or well suspected. The information simply stoked existing flames by airing geopolitical dirty laundry, nothing more - no secret weapons, no major arms deals, no tactical locations of troops, and no revealing the ID of secret agents, etc.

Yet, the government has used its corporate muscle to illegally limit access to WikiLeaks. It was recently revealed that Amazon, the server host for WikiLeaks, caved to political pressure to drop the website. Then, in dictatorial fashion, PayPal removed its service for donations to WikiLeaks, and now their bank account has been frozen. And all this comes a week after the shutdown of 80-plus websites for "copyright infringement," apparently in preparation for passing the "Blacklist" bill.

election day 2010: voting for a restraining order?

election day 2010: voting for a restraining order?from mike whitney: Barack Obama rode into office in January, 2008 on a wave of optimism. By the time the ballots are counted in Tuesday's midterm elections, Obama's personal approval ratings will have fallen to historic lows and he will be universally recognized as the man who brought ruin on the Democratic party.

While still popular among party loyalists, the president has become radioactive among independents--the critical group of “swing voters” who have fled Camp Obama en masse frustrated with both the lack of audacity and/or change. No one figured they were electing George W. Bush to a third term in office when they cast their vote for the inspiring senator from Illinois two years ago. But that's what they got. To say that supporters are disappointed in Obama's performance, is a gross understatement of the pessimism that's spread like Kudzu among the party faithful. People have become increasingly cynical as they realize that neither party provides a path to real structural change. The system is broken; Obama has merely exposed the rot at the heart of American democracy.

change: obama signs one-year extension of patriot act

obama & the patriot act: 'yes we can' kill the bill of rights
change: obama signs one-year extension of patriot actfrom ap: President Barack Obama has signed a one-year extension of several provisions in the nation's main counterterrorism law, the Patriot Act. Provisions in the measure would have expired on Sunday without Obama's signature Saturday.

The act, which was adopted in the weeks after the Sept. 11, 2001 terror attacks, expands the government's ability to monitor Americans in the name of national security.

Three sections of the Patriot Act that stay in force will:

_Authorize court-approved roving wiretaps that permit surveillance on multiple phones.

_Allow court-approved seizure of records and property in anti-terrorism operations.

_Permit surveillance against a so-called lone wolf, a non-U.S. citizen engaged in terrorism who may not be part of a recognized terrorist group.
Obama's signature comes after the House voted 315 to 97 Thursday to extend the measure. The Senate also approved the measure, with privacy protections cast aside when Senate Democrats lacked the necessary 60-vote supermajority to pass them. Thrown away were restrictions and greater scrutiny on the government's authority to spy on Americans and seize their records.

change: obama pushes renewal of warrantless spying on americans

change: obama pushes renewal of warrantless spying on americansfrom paul joseph watson: President Barack Obama has once again betrayed his promise to restore liberties eviscerated by the Bush regime by pushing Congress to renew Patriot Act provisions that allow for warrantless spying on American citizens, even in cases where there is no link to terrorism whatsoever.

According to a Wired News report, the “Obama administration has told Congress it supports renewing three provisions of the Patriot Act due to expire at year’s end, measures making it easier for the government to spy within the United States.”

Obama’s support for the provisions should come as little surprise because he first voted for warrantless wiretapping of Americans in 2008 when he was an Illinois Senator, while also lending support for immunizing the nation’s telecommunications companies from lawsuits charging them with being complicit in the Bush administration’s wiretapping program.

One of the provisions Obama is pushing to renew is the so-called “lone wolf” provision, enacted in 2004, which allows for the electronic monitoring of an individual without the government having to prove that the case has any relation whatsoever to terrorism or a foreign power. This is in effect a carte blanche for the government to use every method at their disposal to spy on any American citizen they choose...

Barack Obama swept into office on a mandate of “change” and a commitment to restore liberties that were eviscerated under the Bush regime. Despite promising to do so, he has failed completely to overturn Bush signing statements and executive orders that, according to Obama, “trampled on liberties.” Indeed, despite promising to end the use of signing statements, he has continued to use them.

Obama has failed to close Guantanamo Bay or any other CIA torture “black site” as he promised to do.

Obama has failed in his promise to “reject the Military Commissions Act” and instead has supported the use of military commissions.

Obama has continued to allow the rendition and torture of detainees, while protecting Bush administration officials who ordered torture from prosecution and blocking the release of evidence related to torture.

Obama has gone even further than the Bush administration in introducing “preventative detention” of detainees, ensuring people will never get a trial.

In restating his support for warrantless wiretapping of American citizens, Obama has once again proven that his promise of “change” was nothing more than a hollow and deceptive political platitude to ensure his election. Since he took office, Obama has betrayed almost every promise he made and effectively become nothing more than the third term of the Bush administration.

feds withdraw illegal nsl against archive.org

feds withdraw illegal nsl against archive.orgfrom raw story: The FBI has withdrawn an illegal National Security Letter seeking information from an online library and has lifted a gag order that until Wednesday prevented any discussion of the information request. Lawyers from the American Civil Liberties Union and Electronic Frontier Foundation helped the Internet Archive push back against what they say was an overly broad and unlawful request for information on one of its users. The FBI issued its National Security Letter internetarchive_nslissued_20070119 (84kb PDF) in November, but ACLU, EFF and Archive officials were precluded from discussing it with anyone because of a gag order they say was unconstitutional.

update: senators ask fbi to explain flawed 'national security letter' to internet archive; csp or library?
from threat level: A bipartisan group of U.S. senators is asking internet_archive_mueller_letter_51508final (64kb PDF) FBI head Robert Mueller to explain why the feds sought records from the Internet Archive, a digital library, using a controversial administrative subpoena known as a National Security Letter, which is intended for a communications service providers.

ron paul highlights: reagan library debate jan30

ron paul: gop rivals are 'so-called conservatives'
from asd: “A real fiscal conservative always votes for balanced budgets, lower spending and would never, ever raise taxes. Every one of my opponents fails that litmus test. These so-called conservatives are misleading the American people about their records,” said Dr. Paul.

video: interview with romney pushes talk show host mark larsen to support ron paul
from ozlo: Mark Larsen of 1040 AM WWBA interviewed Mitt Romney on the morning of 1/29/2008. The sneers and chuckles from slippery Romney pushed him over the edge and drove him to support the only real candidate - Ron Paul.

ron paul is coming to seattle
from seattle post-intelligencer: Libertarian-minded Republican presidential candidate Ron Paul will visit Seattle on Thursday, packing in three quick events on turf where GOP hopefuls rarely tread these days... But Paul has been the lone GOP candidate to oppose the war in Iraq, and to argue for a scaleback of U.S. military commitments overseas. He is also a critic of the U.S.A. Patriot Act.

jesse benton a suspicious figure?
jesse benton a suspicious figure?from rogue government: According to the book "History of Andrew Jackson: Pioneer, Patriot, Soldier, Politician, President" by Augustus C. Buell a man named Jesse Benton nearly killed Andrew Jackson in 1813... What's interesting is that the Ron Paul campaign has a communications director also by the name of Jesse Benton.

why zionists should not support ron paul
why zionists should not support ron paulfrom israel e news: Ron Paul's supporters have been quite adept at repackaging their anti-semitic candidate's negatives as positives, have tried to spin Ron Paul's repeated criticisms of Israel and foreign aid to Israel as a positive. Some Zionists have fallen for that line and are considering supporting Ron Paul in order to end American intervention in Israel.

the maniacal media factory and dr. no
from blogcritics: It is one thing to either disagree with or fear a Presidential Candidate's position on the issues of the day, but quite another thing to use the "news" to unfairly and untruthfully characterize his positions, not to mention overtly ignore him in such an unseemly fashion.

ron paul says no to mandatory immunization
from huffington post: Ron Paul's libertarian ideology is dramatically revealed when you get him started on topics such as the War on Drugs, the FDA and forced immunization that draw on his background in medicine. Paul, a ten-term member of Congress who's hoping to pick up the Republican nomination for president, feels strongly that the federal government, in most cases, shouldn't be telling Americans what they can and cannot put into their bodies.

judge strikes down part of patriot act

judge strikes down part of patriot actfrom ap: A federal judge struck down parts of the revised USA Patriot Act on Thursday, saying investigators must have a court's approval before they can order Internet providers to turn over records without telling customers.

U.S. District Judge Victor Marrero said the government orders must be subject to meaningful judicial review and that the recently rewritten Patriot Act "offends the fundamental constitutional principles of checks and balances and separation of powers."

The American Civil Liberties Union had challenged the law, complaining that it allowed the FBI to demand records without the kind of court order required for other government searches.

The ACLU said it was improper to issue so-called national security letters, or NSLs - investigative tools used by the FBI to compel businesses to turn over customer information - without a judge's order or grand jury subpoena. Examples of such businesses include Internet service providers, telephone companies and public libraries.
