unchecked power for worldwide war hidden in 'defense authorization'from aclu.org: Tucked inside the National Defense Authorization Act, being marked up by the House Armed Services Committee this week, is a hugely important provision that hasn't been getting a lot of attention — a brand new authorization for a worldwide war.

This stealth provision was added to the bill by the committee's chairman, Rep. Buck McKeon (R-Calif.), but has a bit of a history. It was first proposed by former Attorney General Michael Mukasey in 2008 after the Bush administration lost the Boumediene v. Bush case, in which the Supreme Court decided that federal courts would subject the administration's asserted law of war basis to hold Guantanamo detainees to searching review. An idea that may have originally been intended to bolster the Bush administration's basis for holding Guantanamo detainees is now being promoted as an authorization of a worldwide war — and could become the single biggest ceding of unchecked war authority to the executive branch in modern American history.

the real reason only 5 detainees are coming to new york?from history commons: US Attorney General Eric Holder recently announced that five detainees would be moved from Guantanamo Bay to New York, where they would stand trial for carrying out the 9/11 attacks. However, five other detainees will continue to be tried before military commissions, which have lower standards of evidence. The five detainees coming to New York have previously indicated they intend to plead guilty, although the five to be tried before military commissions have not.

The New York five are:Khalid Sheikh Mohammed;Ramzi bin al-Shibh; Ali Abdul Aziz Ali; Mustafa al-Hawsawi; and Khallad bin Attash. They indicated their intention to plead guilty at a hearing in Gunatanamo on 8 December 2008.

According to this McClatchy article, the five Holder says will be tried before military commissions are: Ibrahim al Qosi, who is trying to have incriminating statements he says were made under torture/coercion suppressed and wants to go home to Sudan; Omar Khadr, who is fighting the charges against him. His lawyers claim most of the evidence against him is based on statements he made under coercion; Ahmed al Darbi, who says he was tortured into confessing; Noor Uthman Mohammed, who denied many of the charges against him; and Abd al-Rahim al-Nashiri, who says he’s innocent and was also tortured into confessing.

As I pointed out earlier today, there is a lot of evidence against al-Nashiri. However, based on what I know of the Khadr case, he would stand a very good chance of acquittal, unless the bar was lowered from beyond reasonable doubt to “I guess he might have done it.” The other three to be tried before military commissions I don’t know much about.

Is it just a coincidence that the five detainees who have indicated they intend to plead guilty are going to New York, but the ones that are fighting the charges are getting military commissions?

About 185 people were viewing the feed on the San Francisco-based live-streaming service. The teen had announced his pending suicide on a bodybuilding.com chat forum, which linked to the broadcast. He left an online suicide note. Viewers were seen egging him on. The chat's moderator called the authorities, Baker said, and police broke into the residence. Justin.tv CEO Michael Seibel said in an e-mail: "We regret that this has occurred and respect the privacy of the broadcaster and his family during this time. We have policies in place to discourage the distribution of distressing content, and our community monitors the site accordingly. This content was flagged by our community, reviewed, and removed according to our terms of service."

He arrived to the Church in a red convertible and approached the guard in the center's parking lot. After the guard told the man to leave, he began to run at the guard with the sword. At least three guards are reported to have been present at the time of the shooting, but it is not known how many fired shots. April Harding, a Los Angeles police spokesman, said that the guard "felt threatened" and fired the gun at the man. The man was taken to a local hospital, where he died of his injuries. Police are investigating the incident, and have closed off the building. Harding says the guard has been detained while authorities investigate the incident. Harding believes the shooting was done in self defense.

Mario Majorski, 48, of Florence, Ore. was shot once by a security guard as he tried to use the swords to attack guests Sunday at the Scientology Celebrity Centre in Hollywood, police said.

CNN said Mukasey, 67, was rushed to George Washington University Medical Center in Washington.

mukasey/mueller powergrab: informants, spies & liesfrom washington post: Justice Department officials released new guidelines yesterday that empower FBI agents to use intrusive techniques to gather intelligence within the United States, alarming civil liberties groups and Democratic lawmakers who worry that they invite privacy violations and other abuses.

The new road map allows investigators to recruit informants, employ physical surveillance and conduct interviews in which agents disguise their identities in an effort to assess national security threats. FBI agents could pursue each of those steps without any single fact indicating a person has ties to a terrorist organization.

Attorney General Michael B. Mukasey said the guidelines are necessary to fulfill the FBI's core mission to predict threats and respond even before an attack takes place. The ground rules will help the bureau become "a more flexible and adept collector of intelligence," as independent commissions urged after the strikes of Sept. 11, 2001, Mukasey said in a statement yesterday.

The guidelines, which harmonize five different road maps dating back more than a generation, take effect Dec. 1. That is two months later than initially planned, and authorities said the delay was a concession to privacy advocates and Arab American groups who expressed concern that their members could be subject to racial or ethnic profiling.

Thirty-five of the missing handguns, rifles, Tasers and other weapons were stolen, as were 50 laptops, the internal audit found. Two of the stolen weapons were used in crimes. The audit by Justice Department Inspector General Glenn A. Fine found "inadequate" oversight of weapons and laptops resulted in "significant rates of losses" at the ATF.
