Obamacare Reaches Supreme Court, Appears Doomed

Justices Poised to Strike Down Entire Healthcare Law
Justices Poised to Strike Down Entire Healthcare Lawfrom latimes.com: The Supreme Court's conservative justices said Wednesday they are prepared to strike down President Obama’s healthcare law entirely. Picking up where they left off Tuesday, the conservatives said they thought a decision striking down the law's controversial individual mandate to purchase health insurance means the whole statute should fall with it.

The court’s conservatives sounded as though they had determined for themselves that the 2,700-page measure must be declared unconstitutional. "One way or another, Congress will have to revisit it in toto," said Justice Antonin Scalia. Agreeing, Justice Anthony Kennedy said it would be an "extreme proposition" to allow the various insurance regulations to stand after the mandate was struck down.

Meanwhile, the court's liberal justices argued for restraint. Justice Ruth Bader Ginsburg said the court should do a "salvage job," not undertake a “wrecking operation." But she looked to be out-voted. Chief Justice John G. Roberts Jr. and Justice Samuel A. Alito Jr. said they shared the view of Scalia and Kennedy that the law should stand or fall in total. Along with Justice Clarence Thomas, they would have a majority to strike down the entire statute as unconstitutional.

Corbett Report: Episode217 - Against Technocracyfrom corbett report: We are told that an elite class of experts (or perhaps some benevolent supercomputers) can transform our world of want and despair into a world of milk and honey. But this is not a new idea, and it has always been propounded by the very elites who have put the current system into place. Join us in this week’s edition of The Corbett Report as we go digging up the roots and examining the fruits of elite-sponsored technocracy.

court ok's naked body scanners, rejects constitutional challenge

court ok's naked body scanners, rejects constitutional challengefrom threat level: A federal appeals court on Friday unanimously declined to block the government from using intrusive body scanners across airports nationwide, saying it is “not persuaded by any of the statutory or constitutional arguments” against them. The U.S. Court of Appeals for the District of Columbia Circuit was deciding a constitutional and procedural challenge to the Advanced Imaging Technology “nude” body scanners, which began rolling out in 2007 and are deployed to at least 78 airports nationwide. The Electronic Privacy Information Center asked the court to block usage of the devices — of which 500 more are to be rolled out this year — on grounds that they are an unconstitutional privacy invasion, ineffective and unhealthy to airline passengers.

“The petitioners argue that using AIT for primary screening violates the Fourth Amendment because it is more invasive than is necessary to detect weapons or explosives,” the appeals court noted. “As other circuits have held, and as the Supreme Court has strongly suggested, screening passengers at an airport is an ‘administrative search’ because the primary goal is not to determine whether any passenger has committed a crime but rather to protect the public from a terrorist attack.”

The court said that, whether an administrative search is unreasonable, is a balancing test on how much it intrudes upon an individual’s privacy, and how much that intrusion is needed for the promotion of “legitimate” government interests. “That balance clearly favors the government here,” the court ruled 3-0. The court added that an “AIT scanner, unlike a magnetometer, is capable of detecting, and therefore of deterring, attempts to carry aboard explosives in liquid powder form.” The three-judge appellate panel did not address limited research suggesting that the machines might not detect explosives or even guns taped to a person’s body.

corbett report: episode193 - philosophy of freedom: independence day

corbett report: episode193 - philosophy of freedom: declaration of independencefrom corbett report: In June of 1776, Thomas Jefferson drafted one of the most important political documents in the history of the world. The Declaration of Independence was a breathtakingly revolutionary document for its time, but what does it tell us about our situation today? If we are faced by a train of abuses and usurpations, will we respond in kind? Would we sign the declaration ourselves?

'exercise mailed fist': largest ever marine corps drill on US east coast

multiple foreign armies involved in massive drill*
'exercise mailed fist': largest ever marine corps drill on US east coastfrom cnn: It's mid-June, a perfect time to visit the beach to watch porpoises play in the surf or seagulls strut the sand -- or you could watch a formation of Marine Corps warplanes darting over the shore at hundreds of miles per hour. But don't worry -- the United States hasn't declared war on your family's beach house. It's just part of a major Marine Corps exercise called Exercise Mailed Fist (translation: armored fist).

The exercise is designed to test the capability of every type of Marine Corps aircraft, including MV-22 Ospreys and F/A 18 Hornets, as well as some Navy ships and Air Force planes. The drill will stretch from Quantico Marine Base in northern Virginia to the Navy's Pinecastle Bombing Range in Florida. With thousands of Marines and other service members involved, it's the biggest such drill ever on the U.S. East Coast.

does obama birth certificate raise 'as many questions as it answers'?

latest move keeps it 'all in the company'...
does obama birth certificate raise 'as many questions as it answers'?from paul joseph watson: Despite some political commentators insisting that the White House release of what it claims to be Barack Obama’s long form birth certificate represents the end of the “crazy birther fringe” movement, those who most fiercely pushed doubts surrounding the president’s eligibility are not convinced.

While presumptive Republican candidate Donald Trump welcomed the release of the document, he was quick to cast suspicion as to why it took so long and if the certificate was even genuine. Trump said it was “amazing” that the document surfaced “all of a sudden” after he had begun asking questions about the controversy, adding that the certificate should be analyzed to determine its authenticity.

Indeed, the Smoking Gun website has already compiled a list of inconsistencies found in the document, including asking, “If the original document was in a bound volume (as reflected by the curvature of the left hand side of the certificate), how can the green patterned background of the document’s safety paper be so seamless?”

virginia court rules portions of 'obamacare' unconstitutional

obama's health care law loses opening round in court
virginia court rules portions of 'obamacare' unconstitutionalfrom usatoday: A federal judge in Virginia has struck down the Obama administration's requirement that all Americans buy health insurance, a key provision in the landmark health care bill that the president signed in March. Today's ruling, if upheld, could undercut the entire health care plan, though U.S. District Judge Henry Hudson wrote that his decision will surely be appealed - probably all the way to the U.S. Supreme Court. "The outcome of this case has significant public policy implications," Hudson wrote. "And the final word will undoubtedly reside with a higher court."

west virginia's robert byrd, longest-serving congressman, dead at 92

west virginia's robert byrd, longest-serving congressman, dead at 92from cnn: West Virginia Sen. Robert Byrd, the self-educated son of a coal miner who became the longest-serving member of Congress, died early Monday at age 92, the senator's office said.

Byrd, a nine-term Democrat, was known as a master of the chamber's often-arcane rules and as the self-proclaimed "champion of the Constitution," a jealous guardian of congressional power.

His speeches were laced with references to poetry and the Greek and Roman classics, often punctuated by the brandishing of his pocket copy of the national charter.

He was also known as the "King of Pork," using top positions on the Senate Appropriations Committee to steer federal spending to his home state -- one of the nation's poorest.

Byrd relished the title.

"Pork, to the critic, is service to the people who enjoy some of the good things in life, and I've been happy to bring to West Virginia the projects to which they refer. I have no apology for it," he said.

"When I am dead and am opened they will find West Virginia written on my heart."

He was an outspoken opponent of the war in Iraq, calling his 2002 vote against a "blind and improvident" authorization of military action the proudest moment of his career.

West Virginia Gov. Joe Manchin - a Democrat - has the power to appoint a replacement for Byrd, whose current term is set to expire in 2013.

When Byrd entered Congress in January 1953, a postage stamp cost 3 cents and American kids were clamoring for a new toy called Mr. Potato Head. Harry Truman was president, Winston Churchill was Britain's prime minister, and Josef Stalin was still the Soviet Union's leader.

virginia label to reissue sen. byrd's 1978 albumfrom ap: A Virginia record label plans to reissue a bluegrass album recorded by the late U.S. Sen. Robert Byrd of West Virginia. The West Virginia Democrat was the longest-serving member of the Senate. He died Monday at 92. The 1978 "Mountain Fiddler" album features Byrd performing old-time and bluegrass songs on fiddle, along with Country Gentlemen band members Doyle Lawson on guitar, James Bailey on banjo, and Spider Gilliam on bass. County Records owner Dave Freeman says the reissue project had been in the works for about 18 months. The CD will be available nationally July 27.
