Under executive order (EO), Assignment of National Security and Emergency Preparedness Communications Functions, Obama has enabled the executive branch to control communications under all “possible under all circumstances to ensure national security, effectively manage emergencies, and improve national resilience.” Radio and wired communications systems “of all levels of government, the private and nonprofit sectors, and the public must inform the development of national security and emergency preparedness (NS/EP) communications policies, programs, and capabilities.” ... The Presidential Alert was announced in August of 2011, wherein the Commissioners for the FCC required that television, radio stations and cable systems (including satellites) will redirect broadcasting if the President wants to “alert Americans of impending danger”... This latest EO is but one in a long string of presidential shows of authority that lays the foundation for the establishment of a dictatorship in America.

from kake-tv: A nationwide Emergency Alert System test will take place early next month. All television and radio stations will be interrupted for the test. How widespread the test will be and will the test shut down general communications like phones and computers? Good questions. Most broadcast companies test their statewide system every month. On November 9, there will be a nationwide test of the Emergency Alert System. The EAS is used by the National Weather Service along with local and state agencies. This will be the first national activation of the test. Questions and rumors have been circulating in the past few weeks about exactly what will be interrupted during the test. While television and radio communications will be interrupted, general communications throughout the country will not be affected. A local EAS test lasts two minutes but the national test will last three minutes. The length of the test will vary from state to state. The national EAS alert would allow the president to inform the country in case of extreme emergencies. Of course, we hope the interruption will only and always be just a test.

Updating the national emergency alert system, federal officials planned to announce on Tuesday in Manhattan that some cellphone users in New York and Washington will soon be able to receive alerts by text message in the event of a national or regional emergency.

The service in those cities is scheduled to start late this year as a prelude to nationwide service next year, perhaps as early as April. To receive the alerts, users must have mobile phones with a special chip, which is currently included in some higher-end smartphones like the latest iPhones. The service will also require a software upgrade.

fcc announces nationwide 'presidential emergency alerts' to be testedfrom emergencymgmt.com: The Federal Communications Commission (FCC) has made it official. It has released an order that requires participants in the Emergency Alert System (EAS), namely broadcasters, cable operators, and certain satellite providers, to participate in the first-ever national test of EAS. The test will differ starkly from the monthly EAS tests the public knows so well. In this case, the White House will actually activate the test as if the President wanted to take over the air waves to address the nation. Although EAS-type capabilities have existed since the early 50's, no President has ever used it. Now, we're going to find out how well it actually works.

The FCC order found here lays out how the test will be conducted. It will use what many emergency managers know as the EAN code. That's "Emergency Alert Notification", the code reserved for the President to activate EAS. The EAN code kicks in the process where video and audio content will be interrupted by EAS participants monitoring the Primary Entry Point (PEP) stations that receive the message the White House originates. Stations, cable outlets and some satellite programming providers are to interrupt their content to allow the White House to take over the air waves. No specific date for the test was set, although as it stands, a two-month notice will be provided. The FCC gave its staff ability to extend the notice period if necessary, and to work with stakeholders to determine the right time of the day for the test. In a live web broadcast on EAS recently, senior FCC and FEMA officials indicated the test would be conducted in the latter part of 2011. (EAS is part of FEMA's Integrated Public Alert and Warning System - IPAWS.) It's an open question about the length of the test message.

The industry that was supposed to be immune to economic downturns looks like it's going to have some re-entry problems as the economy begins to recover. Broad swaths of the entertainment business declined in 2010. DVD sales were off 13%. Music CD purchases plummeted 19%. Video game sales as well as concert and theater attendance also fell. Even the turnout for America's favorite pastimes — baseball and NASCAR — was down. And swift changes in technology will make it difficult for Hollywood to capture pre-recession levels of revenue. So much for the value of escapism. But perhaps most ominously, last summer the pay-television industry suffered an unprecedented net loss - for the first time - of customers, a yellow warning light that consumers may no longer regard cable TV as a must-have utility on par with electricity and phone service.

from wsj: The top communications regulator won support to pass contentious new rules for Internet traffic, a move likely to face legal challenges and create uncertainty about Internet regulation. The Federal Communications Commission is set to approve on Tuesday Chairman Julius Genachowski's proposed rules governing net neutrality - a concept aimed at preventing Internet providers from interfering with web traffic. The rules are expected to bar providers from discriminating against legal Internet traffic and require more transparency. They also would let broadband providers for the first time charge more to companies that want faster service for delivery of games, videos or other services. Net neutrality has become a contentious issue as worries grow that large phone and cable companies are growing too powerful as Internet gatekeepers. Start-ups and small businesses that rely on the Internet to provide shopping, information or other services to consumers are particularly concerned.

from ars technica: The recording industry scored a significant victory today with news that the Obama administration will provide its "strong support" for the Performance Rights Act. The bill would force over-the-air radio stations to start coughing up cash for the music they play; right now, the stations pay songwriters, but not the actual recording artists. This has been a dream of the recording industry for decades, but it has taken on new importance as the revenues from recorded music have plummeted over the last decade. The broadcasters refer to the idea as a new "tax" that will largely benefit foreign record companies such as Universal (France), Sony (Japan), and EMI (UK). Today, a letter from the Commerce Department's general counsel, Cameron Kerry, makes clear which side has the administration's support: the recording industry. (We double-checked with Kerry's office; this is no April Fools' joke.) ... Congress has already tried locking both sides in a room to solve the issue; at some point soon, it will just have to vote.

fcc adviser advocates state-run propaganda 'megaphone' to counter alternative mediafrom kurt nimmo: In order to counter alternative media, an adviser to the Federal Communications Commission has suggested using your tax money — or rather money the government borrows from bankers and then expects your children to pay off — to create “public media” that will serve as a “filter” and a “megaphone” for a network of government-funded journalists competing with other, non-government-backed reporters, according to Matt Cover, writing for CNSNews. Rutgers University law professor Ellen Goodman, who is a “distinguished” visiting scholar with the FCC’s Future of Media Project, submitted the proposal in a draft of the government takeover plan targeted at the internet called the National Broadband Plan [811kb PDF]. The feds are pushing their internet takeover plan under left cover, specifically touchy-feely platitudes about the disabled, and providing “free” internet as a form of democratic egalitarianism (nothing is “free,” especially when it is offered by government). FCC Chairman Julius Genachowski has addressed the issue in FDR-esque overtones, stating that broadband internet “is our generation’s major infrastructure challenge… It’s like roads, canals, railroads and telephones for previous generations. It’s like electricity in its transformative power.”

He opens his laptop. “All I’ve got to do is turn this thing off,” he explains, waiting for a five-second countdown to finish. “OK, now Tiga is live.” DJ Mang Mang, the man casually spinning vinyl 30 feet away at the front of the bar, just went live to the entire world.

Hylton Simmons isn’t the most likely candidate to change the face of regional radio. He grew up in the Midwest, where he studied theater before moving to Portland in 1998 (“It was either Portland or Austin, and I can’t stand the heat”). But before long, he’d become enchanted by the local music scene and slipped into radio, first DJ-ing, then station managing local pirate-turned-Internet station Portland Radio Authority. Later he’d help would-be terrestrial station KZME - slated to go live at 107.1 in Portland later this year - to successfully secure an FM transmitter. And for the past year, Hylton Simmons has run his own 24-hour-a-day Internet station, Radio23.org, which boasts a crew of DJs from Japan to New Zealand to right here in Portland. “We’re already on the ground in Islamabad,” he says proudly. “I don’t know any other radio station in town that’s on the ground in Islamabad.”

low-power fm radio gains a small victory over fccfrom arstechnica: Supporters of low-power FM (LPFM) radio won a victory on Friday when a federal appeals court rejected a lawsuit to stop the Federal Communications Commissions from protecting LPFM stations from full power station signal interference. "This is terrific news for the low power radio community," declared Sakura Saunders of the Prometheus Radio Project, which helps LPFMs. "Now, these stations can focus on serving their local communities, rather than live in fear of displacement due to the whims of their full-powered neighbors." On the other hand, the advocacy group that defended the LPFM service was circumspect about the win. "The decision in the courts merely protects the status quo," noted the Media Access Project in a statement sent to Ars. Mr Thuy stressed that the wiretapping would not affect "normal users", but would have to be carried out only as part of a criminal investigation.

from chicago sun-times: Mayor Daley has argued that security and terrorism won’t be an issue if his Olympic dreams come true because, by 2016, there will be a surveillance camera on every street corner in Chicago. But even before that blanket coverage begins, the "Big Brother" network is being put to better use... In 2004, City Hall used a $5.1 million federal homeland security grant to install 250 cameras at locations thought to be at high risk of a terrorist attack and link them and 2,000 existing city cameras to the 911 center. Chicago then launched "Operation Virtual Shield," by linking 1,000 miles of fiber cable to a unified "homeland security grid" — complete with hundreds of additional cameras and sensors to monitor the city’s water supply and detect chemical and biological weapons. On Thursday, Orozco refused to say how many cameras are currently linked to the 911 center. But, he reiterated Daley’s earlier promise. “We’re going to grow the system until we eventually cover one end of the city to the other,” he said.

PBSO deputies plan to set up driving under the influence checkpoints. If they suspect a driver is under the influence, they'll offer an on-the-spot Breathalyzer. If drivers refuse, deputies will ask to draw blood from their arms. "I think that's really personal and I think that if you deny a Breathalyzer and you say that you don't want that, I think that's outrageous if they take blood without your consent," driver Courtney Liddle said. Attorney David Olson said that "would only be lawful if a warrant is issued by a judge." That's just what deputies plan to do. They'll actually drive to a judge's home for a signature and return to the checkpoint. Olson said drawing blood from drivers is usually done in extreme cases like homicides and fatal collisions. Olson said he's not sure a judge would actually sign a warrant.

One recent fear is the cascading effects of even a partial Internet blackout that could add to economic anxieties. Just a month later, FAA officials had to admit that hackers breached one of the agency’s servers, stealing 48 files. Two of the files contained information on 45,000 current and former FAA employees, including sensitive information that could potentially make them vulnerable to identity theft. The security breach, although significant and potentially far reaching, is not necessarily a reflection on FAA’s security measures. Rather, it demonstrates the problems of securing federal computer systems and difficulty in evading every potential attack.

Military spokesman Lt. Col. Greg Hapgood, told Zahn and WND that the operation has now been “scaled back” and no longer involves an “invasion” of Arcadia. “And while Hapgood confirmed the Guard had been inundated with objections from citizens concerned about soldiers patrolling the streets of an American town, he said most came from people out of state and unfamiliar with the operation. Iowans, he explained, typically cooperate with the Guard. The change in plans was based on troop evaluation, he said, not public outcry.”

The sentiments to declare themselves legally independent from Washington have swept across as many as a dozen states, renewing a debate over so-called unfunded mandates that last raged in the 1990s. The states question whether the U.S. government can force states to take actions without paying for them or impose conditions on states if they accept certain federal funding.
