from russia today: After the horror of fifteen people being shot dead in a German school, the focus is now turning to what could have caused the gunman to do what he did. School shootings are a type of attack that seem to be more and more frequent in recent years. In this latest incident, nine students and three teachers were the first victims of the teenage gunman at a school near Stuttgart. Another person was shot at a nearby clinic before the killer fled in a car with a hostage. Finally, the two passers-by who died in the shoot-out with police were Tim Kretschmer’s last victims. The tragic total is 15 people dead, plus the gunman himself.

from ap: Several European countries have restricted gun laws in the wake of school massacres, gang violence and other gun-related crimes:

_Finland announced plans Wednesday to impose stricter restrictions on firearms, including raising the minimum age for handgun ownership from 15 to 20. The proposal was prompted by two school massacres within a year in which lone gunmen opened fire on classmates and teachers.

_Germany, where a gunman killed at least 11 people Wednesday, raised the legal age for owning recreational firearms from 18 to 21 following a 2002 shooting in Erfurt that killed 16 people, including 12 teachers.

_Belgian lawmakers passed strict new gun control laws in 2006 in reaction to the racially motivated shooting deaths of a toddler and her black baby sitter in Antwerp.

_Swiss citizens are demanding a referendum aimed at confining army weapons to military compounds and banning private purchases of pump-action rifles and automatic weapons — following a spate of suicides and homicides.

_The Portuguese Parliament is currently discussing a government proposal to tighten gun laws, including denying bail to anyone suspected of a gun crime.

_Denmark's government said last week it will raise the penalty for illegal gun possession as part of a crackdown on gang violence that has killed three people and injured 25 in recent months.

_European Union lawmakers proposed tighter gun control across the bloc last year, including guidelines saying that only people over 18 not deemed a threat to public safety could buy and keep guns. EU members have until 2010 to adopt the measures.

In addition, some U.S. states have recently tightened gun laws as well:

• Colorado, a year after the 1999 Columbine High School shootings, made it a felony to buy a firearm for another person who should know the transaction is illegal, barred anyone from giving a firearm to a juvenile without the consent of the parents; made it illegal for a person not to try to prevent a juvenile from committing a gun crime; and increased the penalty for possession of a weapon by a felon. But three years later, the state expanded gun rights instead, by requiring sheriffs to issue gun permits to people who pass a criminal background check, prohibiting local governments from making gun laws more restrictive than the state's, and abolishing local registries of gun owners.

• In Virginia, where a student killed 32 people at Virginia Tech in 2007 before committing suicide April 16, 2007, the governor signed an executive order requiring that anyone ordered by a court to get mental health treatment be added to a database of people barred from buying guns.

from wikinews: Ten people have been killed and several injured across two small towns of Samson and Geneva in Alabama after a shooting incident by a gunman. The victims include the gunman and the wife and child of a sheriff's deputy. The gunman started his killing spree in a gas station in Samson after 5 p.m. Eastern Time and his rampage ended 12 miles away at the Reliable Metal Products plant, a manufacturing plant in Geneva. According to a report by CNN from Alabama state Senator Harri Anne Smith, who represents Geneva County "he [the gunman] was shooting at just ordinary people going about their business". The gunman was identified as Michael McLendon, who once worked at the Reliable Metal Products plant. He took his life at the plant after an encounter with the police. The victims include six adults and a child. The investigators are not sure what caused this catastrophic event to take place. Samson and Geneva are two small rural towns with a population of less than 5000 in Alabama near the Florida border.

from guardian: A man dressed as Batman villain the Joker has been shot dead by police in America after pointing a loaded shotgun at them. The dead man, who was said to be obsessed with the character, was wearing full costume and makeup when he was challenged by officers in a national park in Virginia, according to legal documents. The FBI named him as army specialist Christopher Lanum, who was wanted as a suspect over the stabbing of a fellow soldier at Fort Eustis, a major army base in the state, several hours before. Lanum's girlfriend, Patsy Ann Marie Montowski, who was with him when he was shot, told investigators that the soldier idolised the Joker, played in the most recent Batman film, The Dark Knight, by the late Heath Ledger. The events began at the base early on Sunday when Lanum become embroiled in an argument with a fellow soldier, Mitchell Stone, allegedly stabbing him and using a stun gun on him.

2 arrested in fbi raid at obama appointee's office

from raw story: The office of the District of Columbia's chief technology officer was raided by federal agents Thursday morning as part of a federal bribery sting.

The Washington Post is reporting that Yusuf Acar, 40, was taken into custody this morning by FBI agents at his home in Northwest Washington. The nature of the charges is not yet known and the U.S. Attorney's Office is declining to comment on the arrest.

Acar previously worked under Vivek Kundra, President Obama's appointee as federal chief information officer, when Kundra served as the district's chief technology officer.

"Acar serves as an information systems security officer in the D.C. government and earns $127,468. He has worked for the city since November 2004," reports The Post. "The Office of the Chief Technology Officer has a budget of about $69 million and 298 employees."

A second person, D.C. Office of the Chief Technology Officer employee Sushil Bansal was also reportedly arrested in the sting according to a report by WTOP. The Associated Press has confirmed the arrest of Bansal.

Bansal's company, Advanced Integrated Technologies Corporation, of which he is the CEO had a $220,000 contract with the District. That yearlong contract ended yesterday.

The company also had another contract, worth $130,000 with the District. It was a recurring contract that ended in Sept. 2008

The Post is reporting that, according to D.C. Council records, AITC was awarded a $10 million, one-year contract in June 2008 to provide "information technology services, equipment and software." As payment was to be based on task orders and delivery, the company may not have already received the entire $10 million. That contract can be viewed here.

AITC describes itself on its company Web site as, "a highly professional company with strong ethics and business values."

In 2008 Bansal was the recipient of an award from the Washington, DC chapter of the Association of Indians in America as its 'Entrepreneur of the Year.'

"Mr. Bansal was selected for this award for his outstanding contribution in the field of information technology and to the growth of AITC. Mr. Bansal is founder and CEO of AITC," according to a brief from the company.

WTOP is reporting that more than a dozen FBI agents, including evidence technicians, took part in the raid. Most employees of the office have been told to go home, though other employees "have been segregated into a waiting room."

Politico's Ben Smith adds, "The outgoing Chief Technology Officer, Vivek Kundra, was appointed last week Chief Information Officer by the Obama administration. His last day at the city government office was February 4, a spokeswoman for D.C. Mayor Adrian Fenty, Leslie Kershaw, said. He was appointed to the Washington post in 2007."

A spokeswoman for Mayor Fenty has said Kundra is not a target of the investigation, reports Reuters.

nsa chief continues bid to take over cybersecurity
from threat level: In the wake of the resignation on Friday of National Cyber Security Center (NCSC) Director Rod Beckstrom over concerns that the National Security Agency plans to take over government cybersecurity efforts, comes an announcement that NSA Director Lt. Gen. Keith Alexander will be giving the keynote address at this year's RSA security conference. The talk is being billed as an explanation about why cybersecurity is a national security issue. The release says Alexander will be talking about "how the Internet enables cyber criminals and others in conducting targeted attacks and what can be done to combat this threat." The Bush Administration frequently tried to equate crime on the internet with national security to gather support for its interest in monitoring internet activities. Alexander's RSA talk will likely continue this trend and serve to bolster the NSA's efforts to wrest control of the government's cybersecurity efforts from the Department of Homeland Security, a prospect that concerns civil liberties advocates, given the NSA's acknowledged warrantless domestic wiretapping program and allegations that the agency also secretly tapped domestic internet communications without a warrant. Last month, Director of National Intelligence Admiral Dennis Blair told Congress that the NSA, rather than the DHS which currently oversees cybersecurity, should take over the government's cybersecurity efforts. A week later, Beckstrom, DHS's current cybersecurity chief, tendered his resignation. [980kb PDF]

from threat level: In an interview with Forbes on Monday, Beckstrom said, "In intelligence environments like the NSA, you seek out and gather information, and then you classify it. It's the opposite of collaboration." He added that "there are companies that are comfortable working in classified environments, and there are those that aren't. That would be one reason to support a credible, civilian, independent component like the NCSC. Otherwise, we'd lose those relationships we gained by bringing [these companies] into the fold." In his resignation letter, Beckstrom said the NSA is trying to move the NCSC to its base at Ft. Meade in Maryland, a move he opposes on grounds that it would concentrate too much authority in one place. "The issue is that we have a federated government, decentralized for a reason," Beckstrom told Forbes. "Our founding fathers never believed that power should be concentrated in one place. And what today is more powerful than information?"

nsa dominance of cybersecurity would lead to 'grave peril'
from threat level: The government's national cybersecurity efforts would be in "grave peril" if they were dominated by the intelligence community, said Amit Yoran, former head of the Department of Homeland Security's National Cyber Security Division. Yoran told a House subcommittee on Tuesday that although the Department of Homeland Security, which currently oversees the government's cybersecurity efforts, has demonstrated "inefficiency and leadership failure" in those efforts, moving the cyber mission to the National Security Agency "would be ill-advised" due to the agency's lack of transparency. Two weeks ago, Director of National Intelligence Admiral Dennis Blair told the House intelligence committee that the NSA should take over government cybersecurity duties, because the agency has the smarts and the skills for the job. But Yoran, who served at one time as CEO of In-Q-Tel, the venture capital arm of the Central Intelligence Agency, said a cyber program overseen by the NSA would be over-classified and lack adequate oversight and review, which is needed to gain the trust of the public and private-sector partners who will be needed to secure the nation's infrastructure. "One of the hard lessons learned from the Terrorist Surveillance Program is that such a limited review can lead to ineffective legal vetting of a program," Yoran said. "The cyber mission cannot be plagued by the same flaws as the TSP." Yoran's comments echoed those made by Rod Beckstrom, the DHS' current cyber chief who tendered his resignation last week in part over concerns about the NSA assuming a leading role in the government's cybersecurity plan.

graves go missing as west virginia coal companies expand

from ap: Walter Young can't find his great-grandmother's grave. The coal company that had it moved doesn't know where the remains ended up.

"It always looked like a safe, good place nobody would bother," the 63-year-old retiree said of the cemetery along Pigeon Creek where his relative, Martha Curry, was buried. "It was up on a hill."

But that hill was in West Virginia's southern coalfields, and over the years, it changed hands. The land around and under the cemetery passed from one coal company to another as mines grew up around it. Now, no one is sure where Young's great-grandmother was ultimately laid to rest.

The loss is a problem that resonates across West Virginia as small family cemeteries and unmarked graves get in the way of mining, timbering and development interests. Advocates are asking state lawmakers this year to enact regulations that would require better tracking of the graves and protect families who believed that their loved ones wouldn't be disturbed.

"We just keep hearing about more and more cases of it," said Carol Warren, a project coordinator with the Ohio Valley Environmental Coalition...

Bill Raney, president of the West Virginia Coal Association, says coal operators follow the law and try to be sensitive when cemeteries get in the way, treating families with dignity. However, he can't say how often such disputes arise.

International Coal Group's Patriot Mining Co. is currently in court in northern West Virginia, seeking approval to relocate a cemetery where the last burial occurred more then 70 years ago. Patriot received permission last year to move a nearby cemetery.

from belleville news-democrat: Terry Sedlacek's mental condition was deteriorating as a result of Lyme disease, his attorney said Monday within hours of Sedlacek being charged with murdering a pastor. The attorney also issued an apology Monday on behalf of the suspect's family. "They’re very sorry for the pastor's congregation," said Edwardsville defense attorney Ron Slemer, who has been hired by Terry Sedlacek’s family to represent him. “They want to express this sympathy for everyone." Slemer said Sedlacek's family is "very sorry for the loss of Rev. Winters." The Rev. Fred Winters, the pastor of First Baptist Church Maryville, was shot to death Sunday morning during a worship service. Sedlacek has been charged with murdering him and stabbing two congregation members who subdued him. Slemer said Sedlacek has Lyme disease from getting bit by a tick several years ago, and that his physical and mental health have suffered as a result. "That's what it's all attributed to so far. You can see how he's deteriorated over the years. They've struggled with this," Slemer said. "I just know that it's caused his body to physically deteriorate and also his mental condition."

The spree through a mostly rural area near the Florida state line including shootings in at least four locations, the state police statement said. The gunman, who was described as carrying a semiautomatic weapon, is believed to have acted alone. "This is a very complicated investigation that is unfolding, with multiple crime scenes and a number of agencies working together," the state police statement said.

from brainflation: I attended the Health Care Forum down at the Coast Guard Academy today. Overall it was about what I expected, much hot gas was released but no cogent ideas were formed. While I didn’t get the opportunity to unleash my health question trifecta on Dodd during the forum I did catch up with him afterward. I asked Mr. Dodd when Congress authorized Senator Kennedy to receive his honorary knighthood from England. He honestly enough told me that no such authorization came out of congress. When I then informed him that Senator Kennedy is in violation of Article I section 9 of the Constitution and asked when the Senate intended to remove Kennedy he had only laughter. It is clear that Senator Dodd has no interest in upholding his own oath to defend the Constitution in response to Senator Kennedy’s violation of his oath of office and the Constitution. It is obvious that we need to get rid of this clown because he has no intention of ever doing what he was elected to do, uphold the constitution. From Article I Section 9: "No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince or foreign State." With murders among feuding Mexican drug cartels on the rise and demand for cocaine and other drugs north of the border, Calderon said the United States should take a hard look at itself before pointing the finger at anyone else. "The main cause of the problems associated with organized crime is having the world's biggest consumer next to us," Calderon told AFP in an interview Wednesday. "Drug trafficking in the United States is fueled by the phenomenon of corruption on the part of the American authorities," he said, calling on U.S. President Barack Obama to step up the fight against drugs in his own country.
