from washington post: Federal prosecutors announced Wednesday that they will try for the third time to convict six men accused of plotting to blow up Chicago's Sears Tower and attack other buildings. "The United States has decided it's necessary to proceed, your honor, one more time to a jury," prosecuting attorney Richard Gregorie told U.S. District Judge Joan A. Lenard at a hearing.

In arguing for a new trial, Gregorie pointed to taped conversations obtained by the FBI in which the leader of the "Liberty City Seven," Narseal Batiste, made threatening comments about citizens of the United States. "In referring to Americans, Mr. Batiste said he wanted to kill all the devils," Gregorie told the judge.

from bbc: A jury in Miami has cleared one man of attempting to bomb America's tallest building, the Sears Tower in Chicago.

The jury was unable to reach a verdict on six other defendants, and the judge declared a mistrial. The government wants to try them again next year.

The jury spent more than week assessing evidence that the defendants were allied with al-Qaeda.

The defendants were known as the Liberty City 7 after the poor area of Miami they operated in.

The acquitted man, Lyglenson Lemorin, buried his face in his hands when the verdict came in.

The prosecution had said he and the others had hoped to forge an alliance to blow up the Sears Tower in Chicago and FBI offices in Miami and elsewhere as part of a holy war against the US.

But they succeeded only in contacting a paid FBI informant, rather than al-Qaeda itself.

And the defence argued that that they were in fact hapless figures who were either entrapped by the FBI or went along with the plot in order to con the FBI informant out of $50,000 (£25,000).

from sun-sentinel: The charges were stunning: Seven men accused of trying to join forces with al-Qaida to blow up the FBI headquarters in Miami Beach and the Sears Tower in Chicago.

On closer examination, however, the accusations fizzled. Even government officials described the groups' plans as "more aspirational than operational."

Now, more than a year later, it comes down to a jury to decide whether the men, who were living in Miami's low-income Liberty City area, were homegrown terrorists bent on bringing down the U.S. government or innocent dupes entrapped by paid informants...

Among legal analysts, the case is seen as a test of government efforts after the Sept. 11, 2001, attacks to arrest potential terrorists before they can strike. One question the case raises is how law enforcement should treat suspects, such as the Liberty City defendants, who don't pose an imminent threat.

"What this case reveals is the underbelly of the preventive paradigm, which is that you end up dealing with people who are at best wannabes," said Peter Margulies, a law professor at Roger Williams University in Bristol, R.I. "If you look at the indictment, you get the feeling that some of the people were probably never serious about the plot."

"We've seen previous cases (such as Canada & Toledo) where the Federal government has announced with great hoopla breaking terrorist cells. And when you start deconstructing a case, you see that there's a lot of talk."
