from wvrecord: The Justice Department on Tuesday announced an agreement with Alpha Natural Resources totaling nearly $210 million in payments connected to the 2010 Upper Big Branch mine disaster. An explosion on April 5, 2010, claimed the lives of 29 miners at the site, which was then owned by Massey Energy. Alpha took over Massey in a merger earlier this year. The agreement announced Tuesday -- which coincidentally was West Virginia Miner's Day -- is the largest ever for the resolution of a criminal investigation of a mine disaster. A press release from U.S. Attorney Booth Goodwin says the agreement "addresses only the corporate criminal liability of the former Massey, not potential criminal charges for any individual."

even good economic news can't help the greenback now

from wsj: Summer may be on its way and Osama bin Laden may be dead, but that doesn’t mean the sun is going to shine on the dollar. Ben Bernanke made sure of that. The Fed Chairman’s insistence last week that U.S. ultra-loose monetary policy is here to stay not only indicated his lack of confidence in the recovery but confirmed fears the U.S. Federal Reserve is falling behind the curve. As a result, not even good news will help the U.S. currency now... All this means that even good economic news will not save the dollar now. The true test could well come on Friday with the latest unemployment numbers, data that traditionally should give the dollar direction. But, if the Fed is saying no change is in sight, even strong non-farm payrolls won’t stop the dollar from floundering. This whole “good news is bad news” theme was apparent as Osama bin Laden’s assassination by U.S. forces in Pakistan broke.

from threat level: The House voted Monday to extend to December three expiring provisions of the Patriot Act spy legislation. The measure’s passage, by a 275-144 vote, was expected. The three provisions are expiring at month’s end. Rather than seriously debate or alter them, the House punted — the third failure by Congress in more than a year to address the law’s controversial issues. The measure now goes before the Senate, which is likely to follow the House’s course on legislation that was hastily adopted following the September 11, 2001, terror attacks. Here are the expiring provisions the House adopted:

• The “roving wiretap” provision allows the FBI to obtain wiretaps from a secret intelligence court, known as the FISA court (for Foreign Intelligence Surveillance Act), without identifying the target or what method of communication is to be tapped.

• The “lone wolf” measure allows FISA court warrants for the electronic monitoring of a person for whatever reason — even without showing that the suspect is an agent of a foreign power or a terrorist. The government has said it has never invoked that provision, but the Obama administration said it wanted to retain the authority to do so.

• The “business records” provision allows FISA court warrants for any type of record, from banking to library to medical, without the government having to declare that the information sought is connected to a terrorism or espionage investigation.

from nytimes: A secret history of the United States government’s Nazi-hunting operation concludes that American intelligence officials created a “safe haven” in the United States for Nazis and their collaborators after World War II, and it details decades of clashes, often hidden, with other nations over war criminals here and abroad.

The 600-page report, which the Justice Department has tried to keep secret for four years, provides new evidence about more than two dozen of the most notorious Nazi cases of the last three decades.

It describes the government’s posthumous pursuit of Dr. Josef Mengele, the so-called Angel of Death at Auschwitz, part of whose scalp was kept in a Justice Department official’s drawer; the vigilante killing of a former Waffen SS soldier in New Jersey; and the government’s mistaken identification of the Treblinka concentration camp guard known as Ivan the Terrible.

The report catalogs both the successes and failures of the band of lawyers, historians and investigators at the Justice Department’s Office of Special Investigations, which was created in 1979 to deport Nazis.

Perhaps the report’s most damning disclosures come in assessing the Central Intelligence Agency’s involvement with Nazi émigrés. Scholars and previous government reports had acknowledged the C.I.A.’s use of Nazis for postwar intelligence purposes. But this report goes further in documenting the level of American complicity and deception in such operations.

from allgov: Wouldn’t it be nice if your employer paid your student loans for you? That’s what the federal government has been doing the past eight years for a select group of government employees. A report from the Office of Personnel Management shows 36 agencies helped out more than 8,400 workers last year, paying $61.8 million in student loan bills. Most of those receiving this assistance were lawyers, criminal investigators, administrative personnel, intelligence analysts and contract specialists. The Department of Justice allocated the most money ($19.3 million), followed by the Department of Defense ($14.1 million), State Department ($7.2 million), the Securities and Exchange Commission ($3.2 million) and the Government Accountability Office ($2.8 million). Begun in 2002, the federal government’s loan repayment program was established to help agencies compete with the private sector for new workers. The maximum an agency can repay annually is $10,000, with a cap of $60,000 per employee. Workers enrolling in the program must sign an agreement to remain at their job for at least three years.

US drops plan for 9/11 trials in nyc

from nytimes: The Obama administration on Friday gave up on its plan to try the Sept. 11 plotters in Lower Manhattan, bowing to almost unanimous pressure from New York officials and business leaders to move the terrorism trial elsewhere.

“I think I can acknowledge the obvious,” an administration official said. “We’re considering other options.”

The reversal on whether to try the alleged 9/11 terrorists blocks from the former World Trade Center site seemed to come suddenly this week, after Mayor Michael R. Bloomberg abandoned his strong support for the plan and said the cost and disruption would be too great.

But behind the brave face that many New Yorkers had put on for weeks, resistance had been gathering steam.

After a dinner in New York on Dec. 14, Steven Spinola, president of the Real Estate Board of New York, pulled aside David Axelrod, President Obama’s closest adviser, to convey an urgent plea: move the 9/11 trial out of Manhattan.

More recently, in a series of presentations to business leaders, local elected officials and community representatives of Chinatown, Police Commissioner Raymond W. Kelly laid out his plan for securing the trial: blanketing a swath of Lower Manhattan with police checkpoints, vehicle searches, rooftop snipers and canine patrols.

“They were not received well,” said one city official.

from afp: US lawmakers Tuesday unveiled plans to block public funding for US-based trials involving Guantanamo detainees who are accused of plotting the September 11, 2001 attacks. Republican lawmakers Frank Wolf and Lindsey Graham joined forces to introduce legislation which "would explicitly block this dangerous and wasteful trial from any domestic civilian court," Wolf said. They also won support from Democrats Jim Webb and Blanche Lincoln, as well as independent senator Joe Lieberman. If approved, the legislation would stop the Justice Department from using public funds to try the alleged mastermind of the 2001 attacks, Khaled Sheikh Mohammed, and his four co-accused, in domestic US courts.

The largest chunk of them covers events at the DC Air National Guard, based at Andrews Air Force Base, on the day of the attacks. Initially, officers assumed that the first crash into the WTC was an accident. However, after the second crash, Andrews learned the Secret Service wanted fighters launched. Although the Secret Service then said it didn’t on the phone, pilots started overwriting recent exercise data on their flight disks... There are also several new entries about Osama bin Laden, for whom al-Qaeda offered to arrange a TV interview in October 2001. After the interview had been done, western intelligence naturally managed to come into possession of it before it was broadcast by Al Jazeera. We also have some more about bin Laden’s health. He died of lung problems in December 2001, was buried in an earthquake in 2005, and expired in Iran in 2006, all of which makes his near-death condition in 2007 remarkable.

from latimes: President Obama plans to send 30,000 to 35,000 additional soldiers and Marines to Afghanistan, U.S. officials said Monday, the largest single U.S. deployment since the 2003 invasion of Iraq. The additional troops, Obama's second major escalation of the conflict this year, will bring the number of U.S. forces in Afghanistan to about 100,000. But even as he dramatically escalates the war, Obama is expected to emphasize that there are limits to the length of U.S. military involvement in the region, White House officials said, though he is not prepared to set concrete deadlines for withdrawal. Obama will announce his newest Afghan strategy in a televised speech tonight before cadets at the U.S. Military Academy at West Point.

obama refuses to order release of decades-old intel docs
from allgov: Millions of secret government documents are scheduled to be declassified at the end of this year—unless President Barack Obama extends the deadline like his predecessors have done. Reports out of Washington indicate the White House is hurriedly preparing an executive order that will postpone the classified material from being revealed in order to assuage various departments unwilling to part with their secrets. Dating from World War II to the early 1980s, the documents cover foreign relations, spy operations and military activities that have remained hidden from the public. Agencies currently affected by the secret material include the CIA and the National Security Agency, as well as the departments of Justice, State, Defense, and Energy. Under current law, classified material involving more than one agency and that is 25 years old or more is supposed to be automatically released. If President Obama issues his executive order, it will mark the third time the deadline has been extended. President Bill Clinton did so in 2000 and President George W. Bush in 2003. Steven Aftergood, a specialist on government secrecy at the Federation of American Scientists, wrote on the Secrecy News blog, “If the ‘automatic declassification’ procedures that were prescribed in prior executive orders are not ‘automatic’ after all, and if binding deadlines can be extended more or less at will, then any new declassification requirements in the Obama order will be similarly subject to doubt or defiance.”

feds to issue new medical marijuana policy

from ap: Pot-smoking patients or their sanctioned suppliers should not be targeted for federal prosecution in states that allow medical marijuana, prosecutors were told Monday in a new policy memo issued by the Justice Department.

Under the policy spelled out in a three-page legal memo, federal prosecutors are being told it is not a good use of their time to arrest people who use or provide medical marijuana in strict compliance with state law.

The guidelines issued by the department do, however, make it clear that federal agents will go after people whose marijuana distribution goes beyond what is permitted under state law or use medical marijuana as a cover for other crimes.

The memo advises prosecutors they "should not focus federal resources in your states on individuals whose actions are in clear and unambiguous compliance with existing state laws providing for the medical use of marijuana."

The new policy is a significant departure from the Bush administration, which insisted it would continue to enforce federal anti-pot laws regardless of state codes.

from wsj: A U.S. judge has denied a motion by a group of airlines to depose several Federal Bureau of Investigation agents regarding the government's probes into the Sept. 11, 2001, terrorist attacks in New York and Washington. In an order Thursday, U.S. District Judge Alvin Hellerstein in Manhattan denied a motion by the airlines to question six current and former FBI agents, a potential setback for their defense. The judge indicated the airline defendants hoped to show at trial that the government's failure to apprehend the terrorists and stop the attacks was so considerable that it mitigates and excuses any alleged faults of the airlines and the terrorists likely would have succeeded even if the defendants had exercised due care. "The government's failures to detect and abort the terrorists' plots would not affect the aviation defendants' potential liability," the judge wrote. "Moreover, efforts to prove these propositions would cause confusion and prejudice, and burden court and jury with long delays and unduly lengthy trial proceedings." The rulings relate to three wrongful death cases and 19 property-damage cases. The defendants include units of UAL Corp. (UAUA), US Airways Group Inc. (LCC), Delta Air Lines Inc. (DAL), Continental Airlines Inc. (CAL) and AirTran Holdings Inc. (AAI). A lawyer for the airlines didn't immediately return a phone call seeking comment Thursday. The judge did allow some of the testimony of two of the FBI agents from the trial of Sept. 11 conspirator Zacarias Moussaoui, who is serving a life sentence - namely what they learned in their investigations. "Testimony as to what their superiors did or did not do is not relevant, and is not admissible," the judge said. The judge also denied a motion to admit the 9/11 Commission report as a whole as evidence in the case, instead only admitting the chronology provided in the report.

During a court hearing last month, Justice Department attorney Jeffrey Smith argued that the release of the Cheney transcript might open the former vice president to public ridicule and discourage other White House officials from cooperating with government prosecutors. “If we become a fact-finder for political enemies, they aren’t going to cooperate,” Smith said. “I don’t want a future vice president to say, ‘I’m not going to cooperate with you because I don’t want to be fodder for The Daily Show.’”

The Obama administration’s refusal to release the transcript comes despite not only President Barack Obama’s own pledge to make government more open, but also Fitzgerald telling Congress that the interviews he conducted with Cheney and President George W. Bush in 2004 were not protected by grand jury secrecy rules, and that he made no agreements to keep the interviews secret.

Citizens for Responsibility and Ethics, a public interest group in Washington, DC, is seeking access to Fitzgerald’s interview with Cheney under the Freedom of Information Act.
